Sole Source Exemption
§ G.S. 143-129(e)(6) provides that formal bidding requirements do not apply when:
- Performance or price competition are not available;
- A needed product is available from only one source or supply; or
- Standardization or compatibility is the overriding consideration.
§ This product is only available through one distributor in North Carolina and provides seamless integration with the existing equipment.
§ The City Council must approve purchases made under the sole source exemption.
Explanation
§ A low velocity, less-lethal delivery system fires projectiles to be used by SWAT as a less-lethal option to preserve life in high-risk situations.
§ This equipment will be purchased as a replacement for the current, obsolete delivery system deployed by SWAT.
§ Expenditure is estimated to be $53,000.
