Sole Source Exemption

§                     G.S. 143-129(e)(6) provides that formal bidding requirements do not apply when:

-                     Performance or price competition are not available;

-                     A needed product is available from only one source or supply; or

-                     Standardization or compatibility is the overriding consideration.

§                     Sole sourcing is necessary for this contract because standardization and compatibility is the overriding consideration.

§                     The City Council must approve purchases made under the sole source exception.

§                     In order to maintain compatibility during a repair, replacement pumps and parts may only be obtained from assigned representatives or the manufacturer.

§                     Charlotte Water’s pumps and process equipment need to be repaired and/or replaced in a timely and cost-effective manner in order to meet state and federal permit requirements.

§                     Total contract expenditures across all 17 contracts are estimated to be $5,000,000 over five years.
