Property Owner’s Concerns: The property owner was concerned about restoration of the impacted area after construction and erosion control during and after construction.
City’s Response to Property Owner’s Concerns: City staff included the restoration and erosion control construction notes as part of the construction plans to assure all concerns were addressed and agreed upon.
Recommendation: To avoid delay in the project schedule, staff recommends proceeding to condemnation during which time negotiations can continue, mediation is available and if necessary, just compensation can be determined by the court.
