A.                     Conduct a public hearing on the proposed amendment to the Charlotte Stormwater Ordinance (Chapter 18 of the City Code), and

 

B.                     Adopt an ordinance amending the Charlotte Stormwater Ordinance (Chapter 18 of the City Code).

Explanation

§                     The proposed amendment to City Code Section 18-46 clarifies who is responsible for the storm drainage system after a storm drainage easement is acquired by the city but before the city improvements are constructed.

§                     City Code Section 18-46 currently states that the city’s acceptance of the storm drainage system occurs upon the conveyance of the storm drainage easement. It does not account for the gap in time between property acquisition and construction.

§                     The proposed amendment clarifies that the city’s acceptance of the storm drainage system shall be in accordance with the terms of the storm drainage easement, which specifies what and when maintenance responsibilities transfer from the property owner to the city. All storm drainage easements are signed by the property owner.

§                     The proposed revisions were presented to the Storm Water Advisory Committee, which endorsed the proposed amendment.
