Action:
Approve contracts for affordable housing legal services for a term of one year with the following:
Ellinger & Carr PLLC,
GPS Law Group,
Michael Best & Friedrich, LLP, and
Authorize the City Manager or his designee to negotiate, modify, amend and renew the contracts for up to two, one-year terms with possible price adjustments, consistent with the purpose for which the contracts were approved.

Explanation
Affordable housing legal services are necessary to support the city’s efforts to expand and preserve affordable housing throughout Charlotte.
The contracts will include services such as the preparation, review and recording of affordable housing loan agreements, affordability restrictions, loan modifications and subordination requests, title searches, loan closings, and related services.
On June 29, 2026, the city issued a Request for Proposals (RFP); four responses were received.
The companies selected best meet the city’s needs in terms of qualifications, experience, cost, and responsiveness to RFP requirements.
At renewal, potential price adjustments may be considered based on legitimate and justified increases in the cost of doing business. The ability to consider price adjustments also allows the city to accept decreases, if warranted.
Annual aggregate expenditures are estimated to be $450,000.

Effective July 1, 2026, Session Law 2026-41 eliminated the authority of North Carolina local governments to use race-conscious and gender-conscious contracting requirements. In compliance with the new law, no MBE/WBE/MWBE/MSBE/WSBE/MWSBE goals or compliance requirements will be included in city contracts. SBE goals are not affected and shall continue to be used in compliance with the CBI program and applicable law.
