A. Approve a contract in the amount of $2,209,537 to the lowest responsive, responsible bidder GreenWater Development, Inc. for the Bonlyn Storm Drainage Improvement Project, and
B. Authorize the City Manager to amend the contract consistent with the purpose for which the contract was approved.

Explanation
§ This project will replace aging infrastructure adjacent to East W.T. Harris Boulevard from Bonlyn Drive to Snow Lane through the Brookridge Apartment complex in Council District 5.
§ Work will include grading, storm drainage, sanitary sewer, curb and gutter, driveway, sidewalk, and asphalt paving.
§ On May 20, 2026, the city issued an Invitation to Bid; four bids were received.
§ GreenWater Development, Inc. was selected as the lowest responsive, responsible bidder.
§ The project is anticipated to be complete by the fourth quarter of 2027.

Effective July 1, 2026, Session Law 2026-41 eliminated the authority of North Carolina local governments to use race-conscious and gender-conscious contracting requirements. In compliance with the new law, no MBE/WBE/MWBE/MSBE/WSBE/MWSBE goals or compliance requirements will be included in city contracts. SBE goals are not affected and shall continue to be used in compliance with the CBI program and applicable law.
