Action:
A. Approve a unit price contract with CDM Smith, Inc. for construction administration and inspection services for a term of three years, and
B. Authorize the City Manager to renew the contract for up to three, one-year terms with possible price adjustments and to amend the contract consistent with the purpose for which the contract was approved.

Explanation
§ This contract will provide construction administration and inspection services at the Mallard Creek Water Resource Recovery Facility (WRRF) in Council District 4.
§ Construction administration and inspection services are part of the Mallard Creek Solids Improvement Project and include coordinating or performing required testing, verifying that construction conforms to the approved drawings and specifications, documenting field conditions, and identifying any deviations from the approved design.
§ On April 29, 2026, the city issued a Request for Qualifications (RFQ); one response was received.
§ CDM Smith, Inc. is the best qualified firm to meet the city’s needs on the basis of demonstrated competence and qualification of professional services in response to the RFQ requirements.
§ Annual expenditures are estimated to be $400,000.

Effective July 1, 2026, Session Law 2026-41 eliminated the authority of North Carolina local governments to use race-conscious and gender-conscious contracting requirements. In compliance with the new law, no MBE/WBE/MWBE/MSBE/WSBE/MWSBE goals or compliance requirements will be included in city contracts. SBE goals are not affected and shall continue to be used in compliance with the CBI program and applicable law.
