B. Authorize the City Manager to amend the contract consistent with the purpose for which the contract was approved.

Explanation
§ This contract will remove solids from a 36-inch sanitary sewer outfall to Irwin Creek Wastewater Treatment Plant.
§ The portion of the outfall being cleaned is in Council District 3 and is bounded by Revolution Park Drive to the north and Irwin Creek Wastewater Treatment Plant to the south.
§ On March 24, 2026, the city issued a Request for Proposals (RFP); one response was received.
§ Taplin Group, LLC, meets the city’s needs in terms of qualifications, experience, cost, and responsiveness to RFP requirements.
§ The project is anticipated to be complete by the fourth quarter of 2026.

Effective July 1, 2026, Session Law 2026-41 eliminated the authority of North Carolina local governments to use race-conscious and gender-conscious contracting requirements. In compliance with the new law, no MBE/WBE/MWBE/MSBE/WSBE/MWSBE goals or compliance requirements will be included in city contracts. SBE goals are not affected and shall continue to be used in compliance with the CBI program and applicable law.
Small Business Participation
Contract goals were not established for this contract because the scope of work or goods does not present viable subcontracting opportunities. Taplin Group, LLC will be responsible for 100% of the work or goods, and there are no opportunities to include subcontractors. This assessment was confirmed by CBI and the respective department after reviewing the project’s scope and potential for division into subcontracting opportunities.
