A. Approve a contract in the amount of $2,665,653.43 to the lowest responsive, responsible bidder GS Construction, Inc. dba GS Construction Service, Inc. for the Collective Storm Drainage Improvement Project Series W, and
B. Authorize the City Manager to amend the contract consistent with the purpose for which the contract was approved.

Explanation
§ The contract is part of an ongoing program to provide repairs and/or improvements to storm drainage systems across the city.
§ The contract will address storm drainage systems at:
- 7211 Quail Meadow Lane in Council District 6, and
- 10208 and 10209 Crestwood Drive in Council District 7.
§ On July 10, 2026, the city issued an Invitation to Bid (ITB); two bids were received.
- NC General Statute 143-132 prohibits municipalities from awarding construction contracts over $500,000 without receiving at least three competitive bids from the initial advertisement of the contract. The city may subsequently award the contract even if readvertisements result in fewer than three competitive bids.
§ On August 6, 2026, the city reissued the ITB; two bids were received.
§ GS Construction, Inc. dba GS Construction Service, Inc. was selected as the lowest responsive, responsible bidder.
§ The project is anticipated to be complete by the first quarter of 2028.

Effective July 1, 2026, Session Law 2026-41 eliminated the authority of North Carolina local governments to use race-conscious and gender-conscious contracting requirements. In compliance with the new law, no MBE/WBE/MWBE/MSBE/WSBE/MWSBE goals or compliance requirements will be included in city contracts. SBE goals are not affected and shall continue to be used in compliance with the CBI program and applicable law.
