A. Approve a contract in the amount of $2,027,666.74 to the lowest responsive bidder NJR Group, Inc. for the Charlotte Area Transportation System New Bern Drainage Repair project, and
B. Authorize the City Manager to amend the contract consistent with the purpose for which the contract was approved.

Explanation
§ The Charlotte Area Transportation System requires the installation of a new storm drainage (culvert) crossing across the light rail alignment, located between New Bern Station and Poindexter Road in Council District 3.
§ The new culvert is necessary to provide additional stormwater capacity and resolve ongoing issues that may impact rail infrastructure.
§ On July 19, 2024, the city issued an Invitation to Bid; one bid was received.
- In accordance with North Carolina General Statute Section 143-132, if three bids are not received from reputable and qualified contractors, the project must be re-advertised. During the re-advertisement, the contract may be awarded to the lowest responsible bidder even if only one bid is received from an interested service provider.
§ On August 22, 2024, the city issued a second Invitation to Bid; one bid was received.
§ NJR Group, Inc. was selected as the lowest responsive, responsible bidder.
§ The project is anticipated to be complete by the second quarter of 2025.
